EDITED IN: Of course, if he gets away with it, what about those further up the chain of command who authorized it? The highest placed person whose fingerprints are on the decision to use torture is former Secretary of State Condoleeza Rice. Years ago, I made an unserious entry comparing her to Henry Kissinger; to which someone replied, equally in jest, to ask whether this meant she was a war criminal. Alas, we were both more in the right than we imagined.

Someone will be made to pay for the advice. You're right. It'll most likely be those who carried out their instructions from the Oval Office on down, all the way down to the grunts and officers that actually made good on the orders, as was their job/duty. It'll be someone without high-powered or expensive goverment-paid lawyers who takes the fall.

I thought the highest up we had confirmed input on the torture was Cheney. And you can't pull something like that without the C in C knowing about it.

I defer to your knowledge of the matter. Rice is what I'd heard. And I think we would have trouble proving that GWB had signed anything that incriminated him. Anyway, the surrender of the Obama administration on this point - which is one of the points they had a definite mandate for from the electorate - is shocking.

Well, I don't know if they could prove anything on Cheney; they could barely manage his stooge (Libby).

It's not really shocking at all...The DOJ, the CIA, the FBI, and a host of other people are involved in making sure that they don't lose any power.
